1. Who we are (trader information)
These Terms & Conditions (the "Terms") apply to purchases and bookings made with Performance Base. We operate in Sweden and target consumers in Sweden and the EU/EEA.

2. Scope of services
We offer training and recovery services, which may include (depending on what you choose at checkout or in the booking system):
- Personal training (1-to-1 and PT Duo)
- Small group sessions (where available)
- Consultations and assessments
- Nutrition guidance and coaching
- Recovery services, such as infrared sauna (where available)
The exact content, duration, and availability of a service are shown before purchase/booking and may vary over time.
3. Eligibility and your obligations
- Age: You must be at least 18 years old (or have a guardian purchase/approve on your behalf).
- Accurate information: You must provide correct contact and billing details and keep them up to date.
- Conduct and safety: You must follow staff instructions and studio rules, treat others respectfully, and use equipment responsibly.
4. Ordering, booking, and external checkout provider
Purchases and bookings are typically made via our external checkout/booking provider (currently available on getmana.app) or as otherwise communicated to you. You will see the price, key information, and acceptance flow before you confirm.
- Contract party: Unless explicitly stated otherwise, your contract is with Performance Base (not with the platform provider).
- Order confirmation: You should receive an order/booking confirmation (for example by email). Keep it for your records.
- Corrections: If you notice an error in your booking or order, contact us promptly so we can help correct it.
5. Prices, payment terms, and taxes
- Currency: Prices are shown in Swedish kronor (SEK) unless stated otherwise.
- Total price transparency: The total price and any recurring charges (for memberships) are shown before you place the order.
- VAT (moms): Prices include VAT where applicable, or VAT will be specified at checkout if applicable.
- Payment: Payment methods and billing frequency are shown at checkout and are handled via our payment/booking provider(s).
If we offer promotions or discounts, the conditions and duration will be explained at the time of the offer.
6. Privacy and data protection
We process personal data in connection with enquiries, bookings, and service delivery. For details about how we process personal data and your rights under GDPR, please see our Privacy Policy and Cookie Policy.
7. Memberships (6/12-month commitment), renewals, pauses, and cancellations
Some services are sold as memberships with a commitment period (for example 6 or 12 months) and recurring monthly payments. Details for the specific membership you choose are shown at checkout.
- Commitment period: If your membership has a commitment period, you cannot set an end date before the commitment period ends, unless mandatory consumer law gives you a right to do so (for example, due to our material breach).
- Notice period: You can cancel a membership with 1 month notice. The membership remains active until the end of the notice period.
- Renewal: Unless otherwise stated at checkout, memberships continue after the commitment period on a rolling basis until cancelled with notice.
- Pause/freeze: We may allow pauses due to special circumstances such as pregnancy or injury. We may request supporting documentation (for example a doctor's note). Short vacations and short-term illnesses are normally not valid reasons for a pause.
If we make changes that materially disadvantage you (for example a significant price increase for an ongoing membership), we will inform you in advance and, where applicable, offer you the right to cancel before the change takes effect.
8. Credits and credit bundles (usage, validity, refunds)
- What credits are: Credits are a way to pay for eligible sessions/services in advance. The number of credits required is shown in the booking system.
- Validity: Credit bundles are generally valid for 12 months from purchase unless stated otherwise at checkout.
- Personal use: Credits are personal and may not be resold. Membership credits are for the member (and, where relevant, the named duo participants).
- Expiry: When credits expire, they can no longer be used. We may extend validity in exceptional cases at our discretion, but we are not obliged to.
This section does not limit any statutory rights you may have (for example the right of withdrawal in section 10).
9. Booking, rescheduling, cancellations, and no-shows
Booking rules help us run the studio fairly and safely. The specific rules displayed in the booking system apply to your booking type. Unless otherwise stated:
- Cancellation deadline: You can cancel or reschedule without charge up to 24 hours before the session starts.
- Refunds/credits for cancellations: Where a cancellation qualifies for a refund, we may refund the paid amount as a monetary refund or (for certain booking types) as credits for future use. This does not affect any statutory right you may have to a monetary refund (for example under the right of withdrawal).
- Late cancellations: Cancellations within 24 hours may result in the session being charged and/or the used credit being forfeited.
- No-shows: If you do not attend, you may lose the credit or be charged as if the session was delivered.
- Exceptional situations: We may waive fees in genuine emergencies at our discretion.
For certain membership types, repeated late cancellations/no-shows may lead to temporary suspension or other fair-use measures as described in the booking system.
10. Right of withdrawal (14-day cooling-off period)
If you are a consumer in the EU/EEA and you purchase our services at a distance (online/phone), you normally have a 14-day right of withdrawal under the EU Consumer Rights Directive and Swedish law (Distansavtalslagen).
- How to withdraw: Tell us clearly (for example by email) within 14 days of purchase that you want to withdraw. You can use the model form in section 10.3.
- Starting during the withdrawal period: If you ask us to start providing the service during the 14-day period, and you then withdraw, you must pay for the portion of the service already provided up to the time of withdrawal.
- Fully performed services: If a service has been fully performed during the withdrawal period with your prior express request and acknowledgement, the right of withdrawal does not apply to that completed service.
10.1 Refund timing and method
If you withdraw validly, we will refund payments without undue delay and no later than 14 days from when we are informed of your decision, using the same payment method you used unless you expressly agree otherwise.
10.2 Exclusions and special cases
If Swedish/EU law provides an exclusion or limitation for a specific service type, we will apply it only where lawful and we will not reduce your mandatory rights.

11. Health and safety
- Medical considerations: You are responsible for ensuring you are fit to participate. If you are unsure, consult a healthcare professional before starting.
- Inform us: Tell us about injuries, conditions, or limitations that may affect training or recovery services.
- Risk: Training and recovery activities carry inherent risks. We take reasonable steps to keep the environment safe, but you must follow instructions.

12. Liability and consumer rights
Nothing in these Terms limits any mandatory rights you have under Swedish or EU consumer law.
- Our responsibility: We are responsible for providing the services with reasonable skill and care and as described.
- Limitations: To the extent permitted by Swedish law, we are not liable for indirect or consequential loss.
- Personal injury: We do not exclude or limit liability for personal injury caused by our negligence, fraud, or other liability that cannot be limited by law.
If we also sell goods (for example products in the studio), the Swedish Consumer Sales Act (Konsumentköplagen) applies where relevant.
13. Suspension or termination due to misuse or breach
We may suspend or terminate access to our services (including bookings and memberships) if you misuse the services, breach these Terms, behave in a threatening/unsafe manner, or fail to pay. We will act proportionately and, where reasonable, give you notice and an opportunity to remedy the breach.
14. Changes to these Terms
We may update these Terms from time to time. The updated version will be published on this page with a revised "Last updated" date. For ongoing memberships, changes that materially affect you will be communicated in advance.
15. Governing law and dispute resolution (Sweden, ARN, ODR)
These Terms are governed by Swedish law. If a dispute arises, please contact us first so we can try to resolve it.
- ARN: If you are a consumer, you may bring a dispute to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN). More information: https://www.arn.se/.
- EU ODR: The EU Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr.
If the dispute is not resolved through the above, it may be brought before the competent courts in Sweden, without prejudice to mandatory consumer rules on jurisdiction.
